CONSENT TO TERMS AND CONDITIONS

Access to and use of the travel advisory services of Amy Cochran, owner of A Cochran Luxury Travel LLC or Emily Webber, owner of We Travel Luxe, LLC, collectively doing business as We Travel Luxe (WTL) and our website are subject to acceptance of these terms and conditions (“Terms and Conditions”). By accessing, using or obtaining any content, products, or services from WTL, including through our website, or making payments online through our website or supplier, whether now or in the future, you, the purchaser and/or traveler (“Client” and “passenger” and “you/your”) agree to be bound by these Terms and Conditions. We may also book travel and provide services to your travel companions at your direction, you understand and agree that you are acting on behalf of your travel companions and services for your travel companions are part of the services we provide to you. PLEASE READ THESE TERMS AND CONDITIONS AND AGREE BEFORE PROCEEDING.

We Travel Luxe, LLC and A Cochran Luxury Travel LLC are both affiliated with Travel Experts, a Virtuoso Member, and act as sales agents for the airline, air consolidator, hotel, resort, lodge, car rental company, tour operator, cruise line or other service provider named in your itinerary (collectively, Suppliers).

We are not responsible for and have no control over the acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules.

We assume no responsibility for and you agree we shall not be liable for and you hereby release us from all claims arising out of or related to the Suppliers services including any refund, personal injury, property damage or other loss, accident, delay, inconvenience or irregularity which may be caused by (1) any defaults, wrongful or negligent acts or omissions of Suppliers; (2) any defect or failure of any vehicle, craft, equipment or instrumentality owner, operated or otherwise provided by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party.

Hazards:

We have no special knowledge regarding foreign entry requirements, unsafe conditions, health hazards, weather hazards, supplier bankruptcies, or the suitability for disabled persons of any portion of any tour. For foreign entry requirements, go to http://travel.state.gov/travel_warnings.html. For State Department travel advisories, go to http://travel.state.gov/travel_warnings.html. For foreign health requirements and dangers, go to http://www.cdc.gov/travel/index.htm. You hereby release us from any claims resulting in whole or in part from any problem covered in this paragraph and any other causes not within our control, and to submit all other claims against us within 30 days after the cancellation or return from your trip.

Travel Insurance:

WTL offers access to many optional products and services to enhance every travel experience. Options such as TRAVEL INSURANCE may protect passengers and their investment against adverse circumstances, such as third party supplier default/bankruptcy protection, delay, interruption, missed connections, cancellation, medical emergency transportation/evacuation and repatriation, baggage and personal effects/lost luggage and baggage delay, illness, job loss protection and change of plans, accidental death and disability, travel accident/sickness medical expenses, and more. Unless specifically noted, travel insurance is not included with the Client's itinerary. Without appropriate travel insurance, Client understands and acknowledges that if Client cancels or interrupts Client’s travel for any reason, portions of the trip/tour may not be refunded and WTL and Suppliers’ cancellation penalties will apply, resulting in the loss of your monies up to the full cost of Client’s travel booking and related costs. The purchase of travel insurance, while not required to purchase any other product or service offered by WTL, is strongly recommended. If a Client needs to file an insurance claim, WTL will assist by providing a copy of the travel cost documentation for bookings originated by WTL to the Client. Filing the claim and completing the requirements from the insurer is the Client's responsibility.

Travel Insurance Philosophy

As part of our planning services, we always provide travel insurance options. Our role is to present trusted quotes and resources, answer general process questions, and encourage every traveler to consider coverage.

Please note: We are not insurance agents and cannot interpret policy details, guarantee coverage, or purchase a plan without your written authorization. Ultimately, it is each traveler’s responsibility to decide whether or not to hold an active insurance policy and to ensure that the policy selected meets their personal needs.

If we do not receive confirmation of the purchase of travel insurance, your booking will be documented as declining insurance coverage. Should you wish to purchase a policy independently, you are welcome to do so.

Delays

Transportation delays are increasingly common and can impact the flow of your itinerary. Airlines and other carriers are not legally required to cover costs incurred due to delays, such as meals, accommodations, ground transportation, or missed travel components. While regulatory rules exist, compensation is still limited and varies by airline and situation. For detailed information on your passenger rights, visit the U.S. Department of Transportation’s Aviation Consumer Protection site.

Travel insurance is highly recommended, as it may provide reimbursement for delays, missed connections, or additional travel expenses depending on your policy coverage.

Check Your Itinerary:

It is your responsibility to approve your itinerary as soon as you receive your booked itinerary, check it thoroughly to make sure it is correct as to dates, times, fares, and rates. If your itinerary includes air travel, confirm that your airline reservations reflect your and any travel companions’ names as reflected on each applicable traveler’s form of identification. If you are travelling internationally, check your and any travel companions’ passports to ensure they are valid for the travel you have planned. If you need to order a passport or renew it, we recommend paying the fee to expedite the application. Please also know it is your responsibility to travel with a valid passport. Our recommendation is for passports to remain vailid for six months past the last date of travel as airlines can and will deny boarding even if the country you are visiting allows entry.

Reconfirmation:

Airline schedule changes are quite common today. We urge you to re-check exact flight times prior to departure and prior to your return. Check in 24 hours before your flight.

Cruising:

If you are cruising, we strongly recommend flying into your port a day or two before your cruise is scheduled to leave. With the number of flight delays and cancellations, you can miss your ship if you do not fly in a day or two early. If you or your traveling companions opt to fly in the day a cruise is scheduled to depart, you are responsible for your arrangements if you or your traveling companions have to meet the ship at the first port, or if you or your traveling companions miss the cruise entirely. WTL is not responsible for any monetary losses as a result and will charge a minimum service fee of $100 per traveler and up if the Client wants assistance because the Client or traveling companions missed the ship.

Fees and Costs:

WTL facilitates payment on your behalf via check, credit card or wire transfer, payable to Travel Experts or Suppliers. WTL does not receive any remuneration for doing so, and these funds go directly to Travel Experts or Supplier, as applicable. Funds must clear before payments are made to any Suppliers.

We research and select trusted Suppliers to secure the best and not always the lowest available pricing based on your travel dates and preferences. In most cases, your payment may be processed directly by the Supplier, using their own billing systems and in their local currency.

Please note:
• WTL does not control the currency conversion process for the payment processor our Suppliers use or the exchange rate applied at the time of payment
• Foreign transaction fees may be assessed by your bank or credit card provider.
• These charges are not imposed by WTL are the responsibility of the Client.

Before making your deposit, please review these Terms & Conditions carefully from your Supplier. Submission of your deposit payment signifies your acceptance.

To engage WTL for travel planning, Clients agree to pay an initial nonrefundable planning fee before research or itinerary development begins.

Revisions, cancellations, and refunds:

By having us proceed with a payment or deposit, you are consenting that you agree to the itinerary and its applicable Supplier terms.

Due to the extensive organization involved with booking your custom travel experience, a strict cancellation fee will be applicable to compensate for costs and lost revenue. If cancellation for any reason occurs after confirmation of these arrangements, a cancellation fee of 10% of the total trip cost will be processed by Travel Experts, and a $100 per person change fee will be processed for any revisions requested. This fee will be immediately charged to your credit card on the date of cancellation or change. **We highly recommend securing cancellation insurance.

Disclaimer of Liability:

All prices are thought to be accurate, available, and current at the time of advertising and booking with the Supplier. The information, products, and services may include inaccuracies or typographical errors on the part of Suppliers. WTL assumes no responsibility nor guarantees the accuracy of, including but not limited to, the price, information, and description of products or services listed on a Supplier’s website. WTL is not responsible for any errors made by clients or traveling companions creating their own bookings online. WTL is not liable for acts, errors, omissions, representations, warranties, breaches or negligence of any Supplier, or personal injuries, death, property damage, or other damages or expenses resulting from causes outside the control of WTL.

WTL is not responsible for travel delays or cancellations or any illness, death, injury, damage, or loss of vacation time arising thereafter. Changes to cruise ports of call or itineraries due to mechanical, weather, or world events are at the sole discretion of the cruise line or tour operator and may occur without notice as is any applicable compensation for such occurrences by the Supplier.

WTL is not responsible for the refusal of passage by an airline or cruise line for individuals that they deem unsuitable to travel. Please check your applicable cruise or airline’s website and familiarize yourself with their policies on the refusal of passage. WTL is also not responsible for the refusal of boarding or travel for any passenger who may be turned away from entering a country due to any legal issues that the passenger may be subject to. An example is a passenger who may be denied entry into a country due to a prior felony conviction, unpaid child support, or DWI conviction.

WTL shall not be liable for injuries, damages or losses incurred by the your or your travel companions in connection with services provided by Supplier, contractors, terrorist activities, civil or labor unrest, war declared or undeclared, acts of terrorism, sabotage, vandalism, insurrection, riots, strikes, law enforcement activity, mechanical or construction failures, disease, local laws, climatic conditions, criminal acts, abnormal conditions or developments while you’re are traveling that impact you or your itinerary.

Information on Website:

You agree not to use or authorize the use of this information for any purpose other than personal use, and not to engage or authorize anyone to engage in the resale, redistribution, and use of the information on this website for commercial purposes. Third-party links and pointers are included solely for your convenience and do not constitute any endorsement by us and/or our Suppliers. Any software that is on this website including HTML codes and software made available to download from this website ("Software") is our copyrighted work or the copyrighted work of our Suppliers or Licensors. We Travel Luxe, our trademark. Other product and company names mentioned herein may be the trademarks of their respective owners.

Power of Attorney:

As our client, you hereby appoint us to be your attorneys-in-fact for the purpose of signing all documents necessary to purchase and issue airline tickets, tours, cruises, and hotel guarantees for late arrival. You authorize any of the attorneys-in-fact to sign credit card authorizations for said purchases whenever any of them receives an internet booking request reasonably believed to be from you or someone acting on your behalf, requesting those tickets be charged to this credit card account. You agree that you will pay for all such purchases and will not hold us responsible for any of our actions pursuant to this power of attorney.

Force Majeure:

“Force Majeure” means, in relation to WTL, any circumstances beyond the reasonable control of WTL (including, without limitation, acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, vandalism, insurrection, riots, strikes, civil unrest or disturbance, law enforcement activity, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, wildlife, or other untoward occurrences). WTL shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED FOR ALL NONREFUNDABLE TRAVEL COSTS. If WTL, and/or any of its Suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of WTL or the appropriate Supplier. WTL will, however, use its reasonable efforts to cause you to be reimbursed where possible. WTL will be entitled to deduct from any refund payable to you the reasonable actual and potential costs to WTL of the Force Majeure and applicable cancellation fees.

Regarding destinations in or near areas of war or threat of war declared or undeclared or civil or social unrest, it shall remain your sole and absolute discretion whether to proceed with the trip. If in such circumstances, you choose to cancel the trip, you remain subject to WTL’s and each Supplier’s terms and conditions.

Assumption of Risk

Travel involves inherent risks such as delays, cancellations, health hazards, weather disruptions, and unforeseen events, including civil or social unrest or natural disasters. While WTL strives to ensure a smooth experience, we do not control these events and are not liable for outcomes beyond our control.

Weather Conditions & Natural Elements

WTL cannot guarantee ideal weather or natural conditions during your travels. Elements such as rain, wind, excessive heat, unseasonal cold, hurricanes, earthquakes, and the presence of sargassum seaweed or other natural occurrences are outside of our control and are not considered valid reasons for refunds, rescheduling, or compensation. We strongly encourage all travelers to secure a comprehensive travel insurance policy that offers protection in the event of weather-related disruptions or natural events.

Guest Conduct & Responsibility

WTL maintains strong relationships with our Suppliers. When you engage a Supplier you have entered into an agreement with the Supplier and you are subject to the terms of that agreement. As a result, the Supplier may seek payment including cancellation fees and charges directly from you. As our Client, you, your family, and traveling companions agree to honor that agreement and to conduct yourself in a respectful, courteous, and lawful manner in your interactions with a Supplier. This includes, but is not limited to:

  • Respecting local customs, laws, and cultural sensitivities
    • Treating hotel, resort, and service staff with courtesy
    • Avoiding disruptive, abusive, or intoxicated behaviorthat may negatively affect other guests or service providers
    • Complying with Supplier rules and codes of conduct

Should a Supplier report that you have failed to comply with any agreement or engaged in inappropriate behavior, you may be subject to removal from accommodations, denied participation in activities, or incur additional charges, without refund or compensation. In such cases, WTL reserves the right to discontinue services and is not liable for any associated costs or consequences.

Exclusive Jurisdiction:

Any disputes must first be mediated, and you agree to subject any claims to arbitration in Williamson County, TN.

All suits in connection with, or incident to, this Agreement shall be litigated, if at all, in the federal or state courts of Williamson County, Tennessee, to the exclusion of other courts of any other location.

NO WARRANTIES:

THE CONTENT, CODE, ACCESS, AND OTHER FEATURES OF OUR WEBSITE ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY SUCH FEATURES WILL OPERATE UNINTERRUPTED OR IN AN ERROR-FREE FASHION, THAT DEFECTS WILL BE CORRECTED, OR THAT OUR WEBSITE OR THE SERVER IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. APPLICABLE LAW MAY NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

NO CONSEQUENTIAL DAMAGES:

IN NO EVENT WILL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS AND COST OF PROCUREMENT OF SUBSTITUTE PRODUCTS, ARISING OUT OF YOUR USE OF OUR SERVICES OR THOSE OF OUR SUPPLIERS. EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY TO YOU.
